Terms & Conditions

These Terms and Conditions govern the provision of services by Unreal Productions (“Unreal Productions”, “we”, “our”, “us”) to any client (“Client”, “you”, “your”).

By engaging our services, accepting a quotation, paying an invoice, signing a proposal, or otherwise instructing us to commence work, you agree to these Terms and Conditions.

1. Services

Unreal Productions provides services including but not limited to:

  • Website Design
  • Website Development
  • Website Hosting
  • Website Maintenance
  • Search Engine
  • Optimisation (SEO)
  • Local SEO
  • Content Creation
  • Digital Marketing
  • Graphic Design
  • Branding
  • Consulting
  • Technical Support

 

Service inclusions, deliverables and timelines will be outlined within project proposals, quotations, invoices, or written correspondence.

2. Quotations

All quotations are valid for 30 days unless otherwise specified. Quotes are based on the information supplied by the Client at the time of preparation. Should project requirements change, Unreal Productions reserves the right to revise pricing accordingly. Additional work outside the agreed scope may be charged separately.

3. Deposits

A deposit may be required before project commencement. Upon receipt of a deposit and commencement of work, the deposit becomes non-refundable as it covers:

  • Project planning
  • Administration
  • Research
  • Discovery sessions
  • Resource allocation
  • Design work
  • Development work
  • Initial project setup

 

Where work has commenced and the Client elects to cancel the project, Unreal Productions reserves the right to retain the deposit and invoice for any additional work completed beyond the deposit value. Nothing within these Terms limits any rights available under Australian Consumer Law.

4. Project Cancellation

The Client may cancel a project by providing written notice.

Upon cancellation:

  • Deposits remain non-refundable once work has commenced.
  • Completed work remains payable.
  • Outstanding invoices become immediately due.
  • Deliverables may be withheld until payment is received.

 

Unreal Productions may terminate a project where:

  • Payments remain overdue.
  • The Client becomes abusive or unreasonable.
  • Required information is repeatedly withheld.
  • The project becomes commercially unviable.

5. Client Responsibilites

The Client agrees to:

  • Provide accurate information.
  • Supply required content promptly.
  • Review and approve work within reasonable timeframes.
  • Maintain ownership rights to supplied content.

 

The Client warrants that any content provided to Unreal Productions:

  • Does not infringe copyright.
  • Does not infringe trademarks.
  • Is lawful to use.
  • Does not violate third-party rights.

 

The Client indemnifies Unreal Productions against claims arising from content supplied by the Client.

6. Delays

Project timelines rely on timely communication and feedback. Unreal Productions is not responsible for delays caused by:

  • Late client feedback
  • Missing content
  • Third-party suppliers
  • Hosting providers
  • Domain registrars
  • External technical issues
  • Events beyond our control

 

Projects inactive for more than 30 days due to client delay may be archived or rescheduled. Additional fees may apply to reactivate dormant projects.

7. Intellectual Property

Ownership of final deliverables transfers to the Client upon full payment of all outstanding invoices. Until full payment is received:

  • All intellectual property remains the property of Unreal Productions.
  • Usage rights are not granted.

 

Unreal Productions retains ownership of:

  • Internal systems
  • Methodologies
  • Frameworks
  • Processes
  • Templates
  • Custom tools
  • Proprietary assets

 

Unless otherwise agreed, Unreal Productions may display completed projects within its portfolio, marketing materials, social media, and promotional activities.

8. Website Hosting

Where hosting services are provided:

  • Hosting fees are payable in advance.
  • Hosting services automatically renew unless cancelled in writing.
  • Clients remain responsible for maintaining current payment details.

 

Unreal Productions will take reasonable measures to maintain service availability but does not guarantee uninterrupted operation. Hosting services may be suspended where invoices remain unpaid. The Client acknowledges that temporary interruptions may occur due to:

  • Server maintenance
  • Security updates
  • Third-party outages
  • Software updates
  • Circumstances outside our control

9. Website Maintenance

Maintenance services may include:

  • Plugin updates
  • Theme updates
  • Security monitoring
  • Backup management
  • Minor content updates
  • Technical support

 

Maintenance plans are ongoing subscriptions unless otherwise specified.

Unused support time does not roll over unless agreed in writing.

Emergency work or requests outside the maintenance scope may incur additional charges.

10. Search Engine Optimisation (SEO)

SEO services are provided on a best-efforts basis.

The Client acknowledges that:

  • Search rankings cannot be guaranteed.
  • Traffic increases cannot be guaranteed.
  • Lead generation outcomes cannot be guaranteed.
  • Search engines regularly update algorithms.

 

Ranking fluctuations may occur due to:

  • Algorithm updates
  • Competitor activity
  • Website history
  • Industry conditions
  • Technical issues outside our control

 

SEO services generally require ongoing implementation over several months before meaningful results are observed.

No guarantee is made regarding specific ranking positions.

11. SEO Service Terms

Unless otherwise agreed:

  • SEO campaigns operate on a minimum three-month engagement.
  • Monthly services automatically renew.
  • Cancellation requires 30 days written notice.

 

Fees paid for completed monthly SEO work are non-refundable.

12. AI Assisted Content

Unreal Productions may utilise artificial intelligence tools to assist with content creation, drafting, coding, optimisation, research, or productivity.

All AI-assisted outputs are reviewed prior to delivery where reasonably practicable.

The Client acknowledges that AI-generated content may contain inaccuracies and remains responsible for reviewing and approving final content before publication.

13. Domains and Third Party Services

Projects may utilise third-party providers including:

  • Domain registrars
  • Hosting companies
  • Email providers
  • Software vendors
  • Plugin developers
  • Payment gateways
  • Analytics platforms

 

Unreal Productions is not responsible for:

  • Pricing changes
  • Service outages
  • Account suspensions
  • Data loss
  • Security incidents
  • Service discontinuation caused by third-party providers.

 

Domain registration fees are generally non-refundable once registered.

14. Payments

Invoices are payable according to the payment terms stated on the invoice.

Late payments may result in:

  • Service suspension
  • Project delays
  • Website suspension
  • Withholding of deliverables

 

Unreal Productions reserves the right to charge reasonable recovery costs associated with overdue accounts.

15. Chargebacks and Payment Disputes

Clients agree to contact Unreal Productions before initiating a chargeback or payment dispute.

Where services have been delivered in accordance with agreed terms, Unreal Productions reserves the right to contest chargebacks and recover associated costs.

16. Warranties

To the maximum extent permitted by law:

  • Services are provided on an “as is” basis.
  • No warranty is given regarding uninterrupted operation.
  • No guarantee is given regarding business outcomes.

 

Nothing within these Terms excludes statutory rights under Australian Consumer Law.

17. Limitation of Liability

To the maximum extent permitted by law, Unreal Productions shall not be liable for:

  • Loss of profits
  • Loss of revenue
  • Loss of business opportunity
  • Loss of goodwill
  • Indirect losses
  • Consequential losses arising from the use of our services.

 

Where liability cannot be excluded, it is limited to the amount paid by the Client for the relevant service.

18. Indemnity

The Client agrees to indemnify and hold harmless Unreal Productions against claims, losses, damages, liabilities, costs, and expenses arising from:

  • Client-supplied content
  • Breach of these Terms
  • Unlawful activities
  • Intellectual property infringement by the Client

19. Force Majeure

Unreal Productions shall not be liable for delays or failures resulting from events beyond our reasonable control, including:

  • Natural disasters
  • Power outages
  • Internet outages
  • Government actions
  • Pandemics
  • Industrial disputes
  • Cybersecurity incidents
  • Actions, incidents, outages, disasters that are out of our control

 

Affected obligations will be suspended for the duration of the event.

20. Privacy

Collection and use of personal information is governed by our Privacy Policy.

By engaging our services, you consent to the collection and use of information in accordance with that policy.

21. Changes to these terms

Unreal Productions may update these Terms and Conditions from time to time.

Updated versions will be published on our website and become effective upon publication.

22. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
